Supervisors of Student Employees

A direct supervisor of other employees may experience a possible exception to their Student-Directed or Confidential status. A supervisor is obligated to report all forms of prohibited discrimination and harassment in the workplace to the university.

If a student employee/graduate employee shares an experience of sex or gender-based discrimination or harassment, the supervisor would be obligated to report only if:

  1. they directly supervise the student or they directly supervise the person who may have harmed the student;
  2. the discrimination or harassment occurred in the workplace (meaning it was work related, occurred during work or otherwise affects the work of the employee); and
  3. they are a supervisor as defined in the Student Sexual and Gender-Based Harassment and Violence Complaint and Response Policy (section II(k) defining “supervisors.”)

Are you a supervisor?

Determine if you are a supervisor by considering the following questions:

  1. Do you supervise student employees?
  2. Are you a supervisor according to the policy definition: “a Supervisor is a person who has the power to take tangible employment actions against an employee, i.e., to effect a significant change of employment status, such as hiring, firing, failing to promote, reassignment with significantly different responsibilities, or a decision causing a significant change in benefits.”

Just because a your title contains the word supervisor, you may not necessarily be a supervisor for purposes of this policy. If you need help making a final determination, contact your supervisor or the Office of Investigations and Civil Rights Compliance.

Hypothetical Situations

Situation 1
A student you supervise discloses information about workplace harassment or discrimination directly to you. 

You are obligated to report the incident to the Title IX Coordinator.

Situation 2
A student you supervise is the alleged wrongdoer and the affected student discloses workplace harassment directly to you.

You are obligated to report the incident to the Title IX Coordinator.

Supervisors who directly witness any type of discrimination and harassment in the workplace are required to report.
